Divorce-Based I-751 Waiver Petition to Remove Conditions on Residence Waiver GRANTED

In a July 2018 decision, USCIS approved client’s I-751 Waiver within 5 months of filing without issuing a Request for Evidence or requiring client to appear at an interview.


Our client had a bona fide marriage. However, her ex-spouse was controlling and client did not have access to the family’s finances. During a bitter divorce proceeding, the ex-spouse falsely accused her as engaging in immigration marriage fraud. Client’s ex-spouse went so far as sending letters and spoke to a USCIS officer in person in an attempt to derail client's immigration case.


In our petition, we were able to provide evidence and credible witness statements to address false allegations. Subsequently, we are pleased to learn that USCIS believed our client and issued her permanent green card.
