I-751 Waiver Petition GRANTED – Attorney Successfully REVERSED Previous Denial - Deportation Proceeding TERMINATED
In a December 2017 decision, Attorney received USCIS approval decision of client’s I-751 Waiver Petition, and successfully reversed an USCIS’s previous denial decision.
Our client had a bona fide marriage. She filed a joint I-751 petition with her husband without the assistance of counsel in 2010. The couple was subsequently interviewed by USCIS in 2011. During the interview, USCIS separated the couple and questioned them individually. Subsequently, in just two months later, USCIS issued a lengthy 10 pages denial letter detailing all inconsistencies in the couple’s testimonies and alleged marriage fraud.
Then, just in the next two months, USCIS placed our client in removal proceeding with San Francisco Immigration Court. Client hired an attorney to represent her in the removal proceeding.
After 4 years of waiting and multiple exhausting court days with Immigration Court with no significant results, client’s marriage unfortunately fell apart. Client filed for divorce, then came to our office in 2015 seeking to substitute counsel.
Our office then filed an I-751 waiver petition based on good faith marriage. We also filed a Motion to Administratively Close the proceeding with Immigration Court and appeared with client at her Master Calendar hearing. The Immigration Judge granted our motion and client no longer needed to appear in court.
As expected, USCIS issued a Request for Further Evidence in 2015, which our office assisted client preparing an extensive response. In 2017, attorney appeared at the interview with client at San Francisco USCIS Field Office. Within 4 weeks after the interview, client received the approval of her I-751 and her 10-year green card.
Attorney immediately filed a Motion to Terminate with Immigration Court and it was immediately granted. The firm is very pleased that we were able to assist client to overturn a denial with serious wrongful allegation of marriage fraud. We were also very excited to assist client to obtaining her citizenship.
