I-751 Waiver Petition GRANTED – Attorney Successfully REVERSED Previous Denial (October 2019)

In an October 2019 decision, Attorney successfully persuaded USCIS to reverse its previous denial and approved client’s I-751 Waiver Petition based on Good Faith Marriage but Ended in Divorce. 


Our client had a bona fide marriage. She filed a joint I-751 petition with her husband without the assistance of counsel in 2013. The couple was subsequently interviewed by USCIS in 2015. While the petition is pending for adjudication, unfortunately client's marriage fell apart. Client filed for divorced and hired an attorney to assist her with the refiling of a new I-751 Waiver Petition based on good faith marriage. 


Subsequently in 2017, USCIS issued a lengthy Notice of Denial and Termination of Status denying client’s I-751 petition. USCIS found client’s testimony was not credible and did not meet the burden of proof.


In 2018, client then refiled her I-751 petition without assistance of counsel. Our office was retained in 2019 to assist client with preparing a supplemental memorandum of law, supporting evidence, and preparing client for the interview. Just 3 months after we submitted our package, client appeared for an interview at USCIS San Jose Field Office and her I-751 Waiver Petition was approved. The firm is very pleased that we were able to assist client to overturn the I-751 denial and obtained successful result for client after many years of waiting.
