Application for Marriage-Based Adjustment of Status GRANTED – Attorney Successfully REVERSED Previous Denial of I-485 green card application - Client Received Green Card

In an August 2018 decision, Attorney received USCIS’s approval decision of client’s I-485 Application, and successfully reversed a USCIS’s previous denial decision.

Our client was a beneficiary of a K1 Fiancée visa petition from her spouse. When she arrived in the U.S., she married her husband and filed form I-485 Adjustment of Status application. After the couple’s interview, USCIS denied client’s I-485 Adjustment of Status application claiming the marriage was not bona fide.

Client hired our office to explore her options. After Attorney Nguyen Luu reviewed client’s record, denial decisions, and previously submitted supporting documents, Attorney Nguyen recommended a refile of the adjustment of status application.

Our office prepared an application with substantial supporting documents and witnesses’ statements. Attorney Nguyen conducted extensive mock interviews with client to prepare for the interview at USCIS and accompanied client to the interview. During the interview, the USCIS Officer again questioned the couple’s marriage, but ultimately approved the application. Client received her green card in August 2018.
