I-601 Waiver Granted for Daughter of LPR Parents in Record Time (May 2020)

In a May 2020 decision, USCIS Service Center in Lincoln Nebraska approved an I-601 Application our office filed on November 2019, approximately five months after submission. 
 
Client is a beneficiary of an immigration petition filed by her U.S. citizen father. Client’s parents are Legal Permanent Residents (“LPR.”) After years of waiting for the visa priority to become current, client was finally interviewed by U.S. Consulate for the immigrant visa only to be found inadmissible for misrepresentation due to her previous marriage with a US Citizen Spouse. Unfortunately, client’s inadmissibility resulted due to client’s failure of responding to a previous Notice of Intent to Revoke from USCIS. Had the client been properly advised or represented by an experienced immigration attorney, client would have known to take proper precautions that would not have deemed her inadmissible. 

After our firm was hired to assist the client, Attorney Nguyen D. Luu vigorously prepared the case to overcome inadmissibility, by presenting a strong case fully supported by duly executed affidavits, documentary evidence, and persuasive legal briefs to establish extreme hardship. 

USCIS approved the case within just 5 short months. The client did not face any further delay by having proper legal representation, and USCIS did not issue any Request for Evidence. Client is currently in the process of finally receiving the immigrant visa to reunite with family members in the US after several years of delays.
