Successfully Overturned USCIS's N-565 Denial Decision and Obtained Court Order Correcting Dates of Birth on Naturalization Certificates (December 2020)

Feb 07, 2021

In December 2020, the Federal  Court of Northern District of California issued an order granting our client's petition to correct her date of birth on Naturalization Certificate.

Our client was a refugee from Vietnam. During her immigration process, her date of birth was recorded incorrectly.  As she fled Vietnam without any legal documents,  she was unable to provide proof of her true date of birth.   In an attempt to correct her important vital record, she initiated various legal proceedings with various state and federal agencies. Over the course of almost 40 years, our client's attempt to correct her date of birth was to no avail.

At one point, our client's form N-565 Application for Replacement Naturalization/Citizenship Document with the United States Citizenship and Immigration Service (“USCIS”) to correct her date of birth on the Certificate of Naturalization was also denied.

Client then retained our office. Attorney Nguyen D. Luu  reviewed client's immigration record and assisted client with the petition. Our firm is pleased to successfully petition the federal court to restore our clients' corrected vital information. USCIS's previous denial of our client's N-565 form  has been reversed by the court order.  Client is now waiting to have her new Naturalization Certificate re-issued.
