Successfully Obtained I-485 Approval for Client That Was Previously Associated with CloudParticle (March 2023)

In March 2023, our office received an I-485 approval notice for a client who was previously associated with CloudParticle.


As a F1 visa international student many years prior, our client participated in the OPT program and was hired by CloudParticle. During their initial’s I-485 green card interview in 2022, USCIS heavily questioned our client on their past employment with CloudParticle. Due to the extended passage of time, our client was not prepared and was not able to accurately recount the facts surrounding their past association with CloudParticle.


At the end of the interview, at the request of the USCIS Officer, our client felt that they had to change the response on their I-485 application and essentially admitted that they: 1) worked in the U.S. without authorization; 2) submitted fraudulent documents to the U.S. government to obtain immigration benefits; 3) lied or misrepresented information to the U.S. government obtain immigration benefits.


After the interview, our client immediately contacted our office and sought assistance. Attorney Nguyen D. Luu and our legal team proactively reviewed the facts of our client’s case and determined that our client did not work in the U.S. without authorization and nor made willful misrepresentations to the U.S. Government.


Our client was in great risk to be found inadmissible for misrepresentation and fraud. If our client was unable to overcome the finding of inadmissibility, they would be required to file an I-601 Extreme Hardship waiver.


Our team immediately prepared our clients' statements, attorney legal memo, and presented evidence to support a finding that our clients did not intentionally make false representations to procure a benefit under U.S. immigration laws and they are eligible to adjust status. We worked with our client to accurately recounting their employment and immigration history. We also assisted client to timely retract any misstatement made during their 2022 I-485 interview. We promptly submitted a supplemental package to USCIS.


After receiving our office’s supplemental memorandum and supporting documents, USCIS scheduled our client for a second interview. Ultimately, our client’s I-485 was approved within 4 weeks. The firm is very pleased to learn that USCIS accepted our legal arguments.
