Successfully Obtained H4 Status for Client That Was Previously Associated with Integra Technologies LLC after THREE previous H-1B denials (August 2023)

In August 2023, our office successfully obtained H4 status for a client who was previously associated with Integra Technologies LLC (“Integra”).


As an F1 visa international students, our client participated in the  OPT program and was hired by Integra. Unbeknownst to our client, Integra appeared to be a possible shell company. Integra used elaborate means to entice mostly Indian students to pay for trainings in exchange for obtaining temporary employment to fulfill the requirements of F-1 OPT.  It appears that Integra falsely promised to provide training services, networking opportunities, and internships perceived to be legitimate employment opportunities. Many F-1 students relied on Integra's promises and received job offers from Integra.


After NBC Bay Area's investigation exposing Integra's questionable nature, USCIS has relentlessly pursued the former students that were previously associated with Integra.  USCIS has issued Request for Evidence, Notice of Intent to Deny ("NOID"), interviews by USCIS Fraud Detection Officers, alleging misrepresentation and fraud. Many of the students and former students also received  revocation of F-1 visa and H-1B visa.

 

Previously, our client had THREE approved H-1b petitions from various employers. In all three H-1B petitions, USCIS issued Request for Evidence (RFE) on the issue of maintenance of status and alleged misrepresentation and fraud related to Integra. Ultimately, in all H-1B petitions, USCIS approved the specialty occupation classification portion, but denied our client's change of status portion for reasons relating past association with Integra. When our client then sought the assistance of our office to change status from F-1 to H-4.

Luu and our legal team took on representation to assist our client.  The evidence presented sufficiently supported a finding that the client did not make false representations to procure a benefit under U.S. immigration laws. The firm is very pleased to learn that just within just eight weeks after we have submitted our I-539 application with a clear explanation and attorney legal memo addressing our client's past association with Integra,  USCIS has approved our client H-4 status.
