Nguyen D. Luu is a founding partner of Luu Law P.C. With  more than 12 years of legal excellence, and a genuinely love of solving difficult legal problems and passionate about immigrant rights, Nguyen has successfully assisted clients in obtaining favorable results in an array of complex proceedings, such as obtaining permanent residency, naturalization, appeal, post-conviction relief, deportation defense, federal litigation, Administrative Procedure Act, and Writ of Mandamus.



In recent years, Nguyen has dedicated a significant portion of his practice to litigate immigration cases in Federal District Courts throughout the United States. These actions challenge erroneous decisions by the U.S. government and compel action on petitions that the U.S. government has failed to adjudicate. Nguyen's track record  includes successful litigations against key agencies such as the U.S. Citizenship and Immigration Services ("USCIS") and the U.S. Department of State ("DOS"). Part of Nguyen’s core philosophy is working closely with his clients to devise short-term solutions while also developing a long-term strategy to maximize favorable outcomes. Nguyen closely evaluates all client matters to consider whether litigation is the proper route to take.


Nguyen is a frequently invited speaker at continuing legal education panels organized by various local and national bar associations and the American Immigration Lawyers Association. Nguyen also regularly participates as an immigration law panelist at various Know Your Rights Legal Clinics and Citizenship workshops hosted by local community organizations that serve underprivileged communities. 


Nguyen served as President of the Vietnamese American Bar Association of Northern California (VABANC) during 2016 and currently serves on the judiciary committee and advisory board of VABANC. Nguyen has a deep commitment to pro bono services and frequently volunteers his time providing pro bono services at VABANC’s monthly legal clinic, in addition to AILA’s legal clinic at Jewish Family Services in Los Gatos.


During June 2010, Nguyen volunteered to help provide bilingual, pro-bono legal education clinics in the Gulf States in response to the urgent legal needs of the Vietnamese American community affected by the BP Oil Disaster. The legal clinics provided access and education concerning BP claims policy affecting thousands of Vietnamese fishermen. For his outstanding and invaluable services to the community during the clinics, Nguyen received special Congressional recognition.


Nguyen is fluent in Vietnamese and conversational in Spanish. Nguyen is also a proud volunteer golf coach at The First Tee- Silicon Valley Chapter, a non-profit organization which purpose is to develop youth through golf, and enable them to build the strength of character that empowers them through a lifetime of new challenges.

Notable successful actions in various federal courts:


  • Correcting Date of Birth on Naturalization Certificates. Multiple successful actions in the Northern District of California, Central District of California, and New Jersey District Court to amend date of birth on Naturalization Certificates and challenge the denial of N-565 Application to Replace Naturalization Certificate.


  • Denial of I-130 Petition for Alien Relative. M.L. v. USCIS et al. (2021), District of Colorado. APA Action challenging the revocation of the approval of I-130 Petition for Alien Relative resulting USCIS entering a joint stipulation conceding to the validity of client’s marriage and expedited the approval of client’s spouse immigrant visa.


  • Denial of I-485 Application and Motion for TRO and Preliminary Injunction. Q.Z. v. USCIS et al. (2023), Eastern District of New York.  APA action and Motion for Temporary Restraining Order and Preliminary Injunction challenging the denial of I-485 Application to Adjust Status based on a family-based petition.


  • Denial of H-1B visa Application. L.C. et al. v. USCIS et al. (2022) Northern District of California. Successful APA action and Motion for Temporary Restraining Order and Preliminary Injunction challenging the denial of H-1B visa petition and Change of Status Request.

  • Denial of H-4 Visa Application. DB et al. v. DOS et al (2023) Western District of Washington Successful Administrative Procedure Act action challenging the denial of H-4 Visa Application due to past association with fraudulent OPT employer Integra.


  • Delayed N-400 application. P.G. v. USCIS et al. (2023) Northern District of California. Successful Mandamus and 1447(b) action challenging a two-year delay of the adjudication of N-400 application after interview. USCIS paid our attorney fees.


  • Delayed Asylum application. A.A. v. USCIS et al. (2023), Northern District of California. Mandamus action challenging a four-year delay of the adjudication of client’s asylum application. USCIS issued the interview notice and approved the asylum application within 120 days.


  • Delayed I-130, I-485 petitions.
  • Northern District of California. Multiple successful Mandamus actions challenging multi-year delay of the adjudication of I-130 Petitions and I-485 Applications.
